Poor action - Defect?

The baits I bought have the line tie much lower than what is pictured. This causes balance problems and the bait swims at an upward angle all the time. Possibly defective baits and not a design flaw?

Very nice lure, swims perfectly and has just the right rate of sink (slow). Plan on buying more than one, I wish I had.
