Defective o-ring

Bought in Aug '11 for son-in-law. Presented to him before I left on a 2 week vacation. When I returned, was told that field of view would not align when viewing through both eye pieces . One field was higher than the other. Looking into the lense from the front showed that an o-ring was not seated properly. It was away from the side wall and in the line of sight. Perhaps it allowed the lense to move, not sure. Very disappointed.
